If students, against their will, under threat or blackmail, are forced to clean a school or surrounding area, it is forced labor by law. And he is forbidden in relation to students.

Teachers may threaten to lower grades or call parents to force students to clean up school grounds, classrooms, or any other room. It is illegal, they have no right to do so. The student in this case may simply refuse to do the cleaning or go to the police to hold the teachers accountable.

What the law says

Clause 14 of Article 50 of the Law on Education of the Russian Federation indicates that it is prohibited to involve students and pupils of civil educational institutions without their consent, without the consent of their parents or legal representatives. Exception: this work is provided for in the educational program.

Article 37 of the Constitution of the Russian Federation directly indicates that labor can only be voluntary and that everyone has the right to choose what to do. And forced labor is forbidden, and in fact it doesn’t matter what the students are forced to do: clean up before school, in classrooms, in corridors. Pupils are not required to agree. And no one has the right to force them.

Article 4 of the Labor Code of the Russian Federation, although it has little relation to schoolchildren, also says that forced labor is prohibited. Especially if a person is forced by threats or fear of punishment.

According to the law, the cleaning of the school should be done by a janitor, who receives a salary for this. Cleaning of classes, corridors, halls, and the school itself should be done by a cleaner. She, too, is paid precisely for this.

If a student is forced to clean, he can:

  • write a statement addressed to the principal in order to obtain exemption from forced labor;

  • if the director refuses to give release, you must write a complaint to the education department;

  • if they do not react there, the parents of the student have the right to sue the school.
